I agree with you both.

Having been in the Security and Abuse filed, I am the one who has dealt with reports of spam and abuse as well as 
security.

We have always advised our customer to insure they have a "double opt-in" process. They are also advised to send 
"update" emails to allow those who want off the list, and who have forgotten they are on one to get removed.

This is not perfect or full proof, but it goes a long way to proving your not a spammer.
