From a truly ethical POV, it seems to mee that passive observation of
potentially criminal acts is more unethical than intervention.

You can "sniff" whatever pass your wire, is your data (In some countries
you could break the law),... even if you are working in an organization like
an university... you could ask to the right people in order to develop a
honeynet and watch the hacker activity. It's not unethical... but if you are
using a uncontrolled environment you could be in trouble...
