In a bid to broaden federal law enforcers' cybercrime-fighting
arsenals, Sens. John Kyl, R-Ariz., and Dianne Feinstein, D-Calif., are
preparing to introduce legislation that would double the maximum jail
term for hackers convicted under federal law.
The proposed Kyl-Feinstein legislation, which Kyl announced today at a
conference on critical infrastructure protection here, would raise the
maximum jail term from five to 10 years for convicted hackers. The
senators could introduce the legislation as early as sometime later
this week.
By allowing "the sentence in more serious cases" to fit the crime, the
legislation will give federal prosecutors more leeway in dealing with
cyber-felons, Kyl said.
While details of the Kyl-Feinstein bill remain to be hammered out, the
legislation will also likely include language creating a limited
shelter under the both the Freedom of Information Act (FOIA) and
federal antitrust law for companies that voluntarily share information
about information attacks they have suffered.
Legislation currently pending in the House of Representatives would
offer the same sort of FOIA and antitrust protections for companies
that share hacking information.
