Not at all. It could be a router sitting in front of
your network. For
example, you connect to your ISP.... evil person B
sniffs the router
that your ISP has in front of you. You only have a
single path to the
outside world.

When the evil person B sniffs the ISP router, he *is*
on the *same network*. When I connect to an ISP, I
become part of their network. So, effectively, if you
are sniffing passively, you must be on the same
network or have physical access to the network
(cable). For wifi, just being in the accesspoint range
makes you ON the network.
