Supreme Court Nixes Speedy Microsoft Appeal
posted by cicero on Tuesday September 26, @03:05PM
    from the so-much-for-"timely"-resolution dept.

So much for a speedy outcome in the Microsoft case. The Supreme
Court said in an 8-1 ruling today (PDF) that the Justice
Department's antitrust suit must proceed through usual channels, which
means a one-or-two-year detour through the DC appeals court. This is
an important win for Microsoft, which has enjoyed favorable rulings
from those appeals court judges before. It's just as impressive a loss
for the Clinton administration, which inadvisedly promised the world a
"timely and efficacious" resolution of the case, in the words of lead
prosecutor Joel Klein at a May 1998 press conference. Klein,
meanwhile, has bailed from the Justice Department, just as the fight
    is starting to get tough.
