After a discussion on Super-DMCA laws this afternoon, it would seem under Illinois law that both the individual using the wireless service without authorization could be brought up on criminal and civil charges. On the other hand, the wireless customer who uses encryption to restrict access could also be interpreted to have violated the statute. Catch-22.
