Yes, this violates the Telephone Consumer Protection Act (47 USC 227
for statute, 47 CFR 64.1200 for FCC regulations).
The TCPA also prohibits pre-recorded advertisements to residences, and
requires that pre-recorded calls contain identification information
about the caller.
George W. Bush's 2002 "get-out-the-vote" campaign for Republicans
violated the TCPA with a pre-recorded call that did not meet the
identification requirements of the law--one hundred million calls.
(At the $500 minimum statutory damages for each violation, that's $50
billion in violations.)
