a "public key" by itself does not provide non-repudiation. An asymmetric algorithm along with a Digital Signature mechanism may provide non-repudiation. See: http://www.tldp.org/HOWTO/Apache-WebDAV-LDAP-HOWTO/ssl.html#AEN429 for more info
