4) Putting the burden of paying the challenger's expenses in challenging apatent (if the patent is overturned) on the patent holder. This would basically mean that if I get myself a trivial patent and somebody decides to challenge it, and it is successfully overturned, I have to pay the challenger's costs. This would create incentive to do a better prior art search and discourage trivial patents.
This would be a bit risky and unreasonable to ask in my opinion. It could mean a DDoS of challengers if MS, as an example, tries to patent anything.
It sounds a bit like a WiKi solution, but I doubt the patent system would ever become open-source and open for changing. :o)
Regardless, if a WiKi of sorts existed for open source algorithms, ideas, etc - online, and documented with dates, that would be an interesting searchable archive for future proof hunting.
