The legislation is quite clear. In the vast majority of law in EU, this is related to the incitement. With a honeynet/pot, you have only a box waiting (is it an incitement) ? I don't think so. Of course, you should provide the maximum security around the box, to not being a big relay to attack other hosts... Legislation is a matter of terminology... Most of people receiving aren't surely french however, if someone (maybe a lawyer, who knows ? :p) knew about the answer or had any questions about that, it would be nice.
