you had told them not to do but they did anyway, who knows).

        I am also not a lawyer, but I'd think that turning around and 
        immediately suing the marketing company that's ruining your 
        good name will probably go a long way in convincing your ISP 
        and/or any legal authorities that you didn't approve of the
        spamming.

        Remember, laws are not a set of if/then statements.
