DNS transfer from dead people -- best practice?

Hi folks,

A friend of mine bought a small brick and mortar business from a
proprietor who has since passed, taking his various login credentials
with him. He did not effect the associated domain transfer at
registrar Squarespace before that whole mess. What's the best practice
for recapturing that domain name? Court? UDRP? Or is there something
lighter weight?

She's had trouble reaching a human being at Squarespace to discuss the
issue with, so if anyone from squarespace is around I'd love to get
your help too.
