Im not a lawyer nor a network expert but it don't really see the problem in performing a nmap OS detection scan agains the user's PC. Doing it may report wich OS the customer's running and probably you could tell that he's using a firewall from the nmap output "port filtered". Isn't it? Sounds like you've just reached Nirvana.... :0 While there are probably simpler ways to find some of this info (start at Page 1: "Is there a 'Start' button at the bottom left of your screen?...), to a degree it certainly makes sense (once you have permission from the user and their ISP) to use tools like nmap to try and determine what else is going on.
