Disclaimer... I'm working for NetApp and got this mailthread from a friend who works with an Internet Security Company. 
He is subscribed to this mailinglist - I'm not...

It is not a Linux Kernel and it is also not a *BSD Kernel. Our Founders and Engineers developed a new Operating System 
from scratch and a new Filesystem (capable of handling Multiprotocol files and including native Snapshot functionality) 
all this work is patented and protected.
